PEKIN, Ill. –Tazewell County State’s Attorney Stewart Umholtz has submitted his unconditional resignation, effective November 30.
Umholtz said he’s announcing his resignation now so that a candidate can be added to November’s general election ballot for the State’s Attorney position. Umholtz was the only candidate nominated in the June primary election to become a Resident Circuit Judge in the county.
An unconditional resignation, effective at future date, may not be withdrawn after it’s received by the officer authorized to fill the vacancy, according to state statute cited by Tazewell County Clerk John Ackerman in a release. The resigning office holder may continue to hold such office until the date or event specified, but no later than the date at which the successor is elected and qualified.
Umholtz has served in the State’s Attorney position since 1995.
He has recommended chief assistant Kevin Johnson be selected to serve in the post. But, Democrats and Republicans will have a chance to slate their preferred candidate prior to the November election.
